Apple Inc (NASDAQ:AAPL), world’s most valuable company by market value, on Tuesday won a court order immediately banning United States sales of Samsung Electronics Co’s Galaxy Tab 10.1 tablet computer as the corporations litigate Apple’s patent-violation charges.
U.S. District Judge Lucy Koh in San Jose, California, issued the order today after rejecting a similar request in December.
Apple’s request was based on an appeals court finding that it would probably get its patent-infringement charge relating to the Tab 10.1 tablet.
Koh reported in today’s ruling that although Samsung would essentially be harmed in this case by being forced to remove its product from the market before the merits can be determined after a full inquiry, the damage faced by Apple absent a ban on the Galaxy Tab 10.1 was greater.
